Past Cases

Successfully defended a seller of $32.5 million mixed-use properties in a specific performance lawsuit. At the commencement of the case, we won a motion to vacate a notice of pendency on the basis that the plaintiff lacked the funds to close. We then won a motion for a summary judgment to dismiss the lawsuit. The dismissal was upheld on appeal and our client retained their $2.25 million down payment.

In a lawsuit from a prominent real estate developer for the specific performance of a contract to purchase their neighbor's air rights, Attorney David Wolf represented the seller and obtained a favorable settlement by arguing that the agreement's "best efforts" clause was too vague to be enforced.

We obtained a preliminary injunction for a yoga studio, affirmatively compelling the landlord to complete the leasehold improvements and enjoining the landlord from re-letting the premises while the lawsuit was pending.

In appellate court, we successfully vacated a $1.3 million judgment against a guarantor of a commercial lease by arguing that the plaintiff-landlord illegally evicted the tenant, thereby relieving the guarantor of their obligation to pay rent.

We successfully completed a $23.5 million acquisition of a newly constructed hotel located in the Lower East Side of Manhattan.

Our firm helped a client complete the sale of a $24 million office building located in the New York City area.
