Successfully defended seller of $32.5 million mixed-use properties in specific performance lawsuit. At commencement of case, won motion to vacate notice of pendency on basis that plaintiff lacked funds to close, then won motion for summary judgment dismissing the lawsuit. Dismissal was upheld on appeal and client retained $2.25 million down payment.
In a lawsuit by a prominent real estate developer for specific performance of contract to purchase its neighbor’s air rights, David represented the seller and obtained a favorable settlement by arguing that the agreement’s “best efforts” clause was too vague to be enforced.
In appellate court, successfully vacated $1.3 million judgment against guarantor of commercial lease by arguing that the plaintiff-landlord illegally evicted the tenant, thereby relieving guarantor of obligation to pay rent.
